Doves, a symbol of hope and love in West Cork

dove

AS part of the 16 Days of Action 2011, West Cork Women Against Violence Project are holding a rememberance event on the 8th December on Wolfe Tone Square in Bantry at 1.00 pm. The Project will showcase 5 Balloons, 4 black and 1 white to visually represent the 1 in 5 women that experience domestic violence in Ireland. We will also release Doves as symbols of hope for the future during this time and have some background musical accompaniment.

Volunteers, staff, members of the public and local dignitaries will assemble for one hour to mark the work domestic violence services do throughout Ireland, and in West Cork. A local County Councillor, Mary Hegarty, who is very supportive of the project's work, will make a short speech. They will also hand out information about the project to passers-by. 8th December is a big shopping day in Bantry, and the day the Christmas lights will be turned on, it will be a great day to send a message of support for women and reach as many people as possible. Participants will be invited back to the offices for hot soup and sandwiches afterwards.

West Cork Women Against Violence Project provides a free and confidential support, listening and information service to women and their children living in West Cork who are either living with emotional, physical, sexual or financial abuse or have left an abusive relationship. The project is made up of staff and volunteers from different areas of West Cork who have undergone training and offer professional support to women who are experiencing / have experienced violence in intimate relationship.

What is currently happening in Ireland around Domestic Violence

To mark this year’s 16 Days of Action Opposing Violence Against Women, in the latest edition of our quarterly newsletter " Whisper" we are highlighting some of the work that is being done in Ireland today to end domestic violence.  Despite economic difficulties many dedicated organisations and individuals continue to progress this work.  Support services and refuges nationwide carry on providing a high quality of support to women experiencing domestic violence. Many organisations are working on awareness raising, including support services, Safe Ireland and Cosc. Awareness raising includes giving the clear message that violence against women and children is not acceptable in Ireland today.

Every year the 16 Days of Action run from November 25 to December 10.  There will be events around the country to mark this.  The White Ribbon Campaign was begun by a group of Canadian men in 1991.  There are now campaigns in many countries internationally.  Last year ‘The Other Half’ was launched, an alliance of men and women working together.  The campaign supports men to talk openly about violence. Keep an eye for what’s happening in your area during this year’s 16 Days of Action .

The Civil Law (Miscellaneous Provisions) Act 2011

Was signed into law 2nd August 2011.

This amends the Domestic Violence Act 1996 to extend the powers of the court to order protection to non-cohabitants and same sex couples.

  • Parents with a child in common are now able to apply for safety orders regardless of cohabitation – they may never have lived together.
  • Cohabiting couples can now apply for safety orders without any specific duration of cohabitation required.
  • The protections of the act are available on the same basis to unmarried same sex couples who have not registered a civil partnership. Same sex couples are now eligible for all D.V. orders in the same way as opposite sex cohabitants.

 Clarity:

  • Re: Cohabitants eligibility for barring order: The time periods of eligibility for application for a barring order are the same as they had been (6 out of 9 months).  For further information see  section from Civil Act  Part 17 – section 60 (b)
  • Dating partners remain outside of the protection of domestic violence legislation - there is no legal recognition. Where domestic  violence exists then the only recourse is through the Non Fatal Offenses Against the Persons Act. For example if a woman has been in a relationship but they have never lived together (even if the relationship has been for 10 years) then she is not eligible for a domestic violence order.

 Central difficulties

There may be an onus of proof on the woman to prove they have cohabited together in order to be eligible (if there are no children from the relationship).

Other parts of the act relevant for information:

 Maintenance:

Part 8 inserts new provisions in the Family Law (Maintenance of Spouses and Chldren Act 1976 that will empower the district court to regard as contempt of court failure by a maintenance debtor to comply with a previous court order and to deal with it accordingly, including by means of imprisonment.
